The Real Palestinian Catastrophe

Via WeeklyStandard
The main achievement of the Gaza border attacks is to remind Israelis that Hamas considers all of Israel's borders illegitimate. The dispute with Hamas isn't over settlements or the "occupation" or Gaza itself. It is over Israel's existence. Yasser Arafat's Fatah party rules in the West Bank and controls both the Palestinian Authority and the PLO. On April 30, PA president and PLO chairman Mahmoud Abbas called a meeting of the Palestine National Council (PNC), the PLO's legislative body. After he delivered a three-hour speech replete with explanations that the Jews have no real historical tie to the Middle East and that European anti-Semitism was caused by the Jews, Abbas had himself reelected by acclamation. The entire scene was a throwback to Castro or Ceausescu. In 2003, Abbas looked like an alternative to Arafat and a potential Israeli peace partner. Fifteen years later those hopes are long gone, which helps explain why the Trump administration has not yet released its peace plan: Abbas would reject it instantly. Whatever the criticism, Israelis will certainly not abandon the West Bank to chaos or to a possible Hamas takeover. Today the establishment of a sovereign Palestinian state is simply too dangerous to Israel and to Jordan to be contemplated. The mishandling of Palestinian affairs by their leaders has been the true Palestinian catastrophe.

Palestinian Rockets Hit Israel, Breaking Hamas Truce

Palestinian Arabs doing what they do best. From Palestinian Rockets Hit Israel, Breaking Hamas Truce:
Three Kassam rockets fired from Gaza on Tuesday struck the Israeli town of Sderot and its environs, constituting the first serious breach of a truce between Israel and Hamas, the Islamic group that controls Gaza. Mark Regev, a spokesman for Israeli Prime Minister Ehud Olmert, said the rocket fire from Gaza had been "a grave violation of the calm" that came into effect last Thursday. Islamic Jihad, a small extremist group, claimed responsibility for the attack. Previous cease-fire understandings in Gaza have fallen apart over the inability of Palestinian leaders to contain the smaller groups.

PA: Hamas Blocked Fuel for Gaza Hospitals

Via PA: Hamas Blocked Fuel for Gaza Hospitals:

The Palestinian Health Ministry in the West Bank on Sunday accused the Islamist Hamas movement of preventing the delivery of fuel oil to hospitals in Gaza.

"Members of Hamas in Gaza opened fire on Sunday on fuel trucks that were full of fuel destined for hospitals in the territory," the ministry said. Israel says it cannot deliver any more fuel as the tanks on the Palestinian side of the fuel terminal are full because Hamas will not allow the distribution of the one million liters of petrol and diesel stored there.

EU Faults Hamas for Gaza Fuel Crisis

Via EU Faults Hamas for Gaza Fuel Crisis:

A statement issued by the EU on the fuel shortage in Gaza placed blame on Hamas.

"Hamas and other militant groups in Gaza have their share in aggravating the humanitarian situation, including through carrying out the attacks on the Nahal Oz and Kerem Shalom crossings," the statement read. "

The [EU] president condemns such actions, which only lead to further suffering of the population." Senior Israeli Foreign Ministry officials said this was one of the few times that an EU statement had actually condemned Hamas by name.

Hamas Disrupts Fuel Supplies to Gaza

Via Hamas Disrupts Fuel Supplies to Gaza:

Hamas militiamen in Gaza on Sunday attacked fuel trucks headed toward the Nahal Oz border crossing to pick up fuel for UNRWA - to enable food distribution - and for hospitals, forcing them to turn back, sources in the Palestinian Petroleum Authority said. "Dozens of Hamas militiamen hurled stones and opened fire at the trucks," the sources added. "The trucks were on their way to receive fuel supplied by Israel. The drivers were forced to turn back. Some of them had their windshields smashed."

Eyewitnesses in Gaza City said that at least on four occasions over the past few weeks, Hamas militiamen confiscated trucks loaded with fuel on their way from Nahal Oz to the city. The fuel was taken to Hamas-controlled security installations.

MFA: Main terrorist attacks carried out at Gaza Strip crossings

Terrorist organizations carry out terrorist attacks at civilian sites that contribute greatly to the welfare of the Palestinian population, such as crossings, while taking advantage of easing of restrictions on the Palestinian population, in order to sabotage the normal Palestinian daily life and any co-existence between Israelis and Palestinians.

Furthermore, by striking at Palestinians' ability to earn a living, the terrorist organizations attempt to present Israel as responsible for the suffering of the Palestinians.

Nov 23, 2000 - Sgt. Samar Hussein, 19, of Hurfeish, was killed when Palestinian snipers opened fire at soldiers patrolling the border fence near the Erez Crossing.

Dec 28, 2000 - Capt. Gad Marasha, 30, of Kiryat Arba and Border Police Sgt.-Maj. Yonatan Vermullen, 29, of Ben-Shemen, were killed when called to dismantle a road-side bomb near the Sufa Crossing in the Gaza Strip. The bomb was dismantled, but another bomb exploded, killing both and wounding two other soldiers. The Islamic Jihad claimed responsibility for the attack.

Nov 26, 2001 - A Palestinian suicide bomber killed himself and lightly wounded two Border Policemen at the Erez Crossing point in the Gaza Strip. The bomber joined workers waiting to be cleared for entry into Israel. Hamas claimed responsibility for the attack.

Apr 12, 2002 - Border policeman St.-Sgt. David Smirnoff, 22, of Ashdod was killed when a Palestinian gunman opened fire near the Erez Crossing, in the Gaza Strip, killing one and injuring another four Israelis. June 8, 2003 - Four IDF soldiers were killed and four reserve soldiers were wounded when Palestinian terrorists wearing IDF uniforms opened fire on an IDF outpost near the Erez checkpoint and industrial zone in the Gaza Strip. Three terrorists were killed by IDF soldiers. The Fatah Al-Aqsa Martyrs Brigades, Hamas and the Islamic Jihad issued a joint statement claiming responsibility for the attack.

Jan 14, 2004 - Four Israelis - three soldiers and one civilian - were killed and 10 wounded when a female suicide bomber detonated a bomb at the Erez Crossing in the Gaza Strip, at the workers crossing terminal in the Erez industrial zone, where magnetic entering cards are issued. Hamas and the Fatah Al Aqsa Martyrs Brigades claimed joint responsibility for the attack. The terminal was severely damaged, and needed to be rebuilt. As a result, Palestinians were not able to enter the industrial zone for several days.

Feb 26, 2004 - Sgt.-Maj.(res. ) Amir Zimmerman, 25, of Kfar Monash was killed and two other soldiers wounded when two Palestinian terrorists opened fire near the Erez Crossing between the Gaza Strip and Israel. Hamas, Islamic Jihad and the military wing of Fatah all claimed responsibility.

Mar 14, 2004 - Ten people were killed and 16 wounded in a double suicide bombing at Ashdod Port. The terrorists infiltrated into Israel from the Gaza Strip via the Karni Crossing while hidden in a double cell wall installed in a cargo container departing the Gaza Strip to Israel. Hamas and Fatah claimed responsibility for the attack.

Apr 17, 2004 - Border Policeman Sgt. Kfir Ohayon, 20, of Eilat was killed, three others wounded when a Palestinian suicide bomber blew himself up at the Erez Crossing. Hamas and Fatah claimed joint responsibility for the attack.

The civilians were killed as result of the explosion, and after the terrorists hurled grenades and opened fire at the civilians working at Karni. Hamas and the Fatah al-Aqsa Martyrs' Brigades claimed joint responsiblity for the attack.

In January 2005, a terrorist attack was thwarted in the community of Ganei Tal in Gush Katif, after a Palestinian gunman infiltrated the greenhouses of the community via the area of the Tufah Crossing used by Palestinian workers on their way to work in Gush Katif.

Stop Supplying Gasoline to Hamas!

The residents of Sderot, represented by Attorney Nitsana Darshan- Leitner, director of Shurat HaDin Israel Law Center (http://www.israellawcenter.org), have dispatched a series of letters to Israeli government, parliamentary, military and legal officials calling upon Israel to stop supplying petroleum to the Hamas-led Gaza Strip. The residents allege in their letters that Hamas siphons off more than half of the gasoline supplied from Israel for use in terror related activities including the daily Kassam rocket attacks, the incessant shootings at the farmers in the field, as well as the murderous attack last week on the Nachal Oz gasoline depot in which two Israeli petrol workers supplying the Gaza line were killed.

"Our lives are being physically threatened daily," said Mrs. Nechi Fendel, a mother of seven who moved to Sderot from Staten Island 15 years ago and works as a computer programmer in Nachal Oz. "For eight years now we are living with non-stop rocket attacks, day in and day out. The Hamas fires endlessly at our farmers in the field, at our schools and at our homes and rather than respond and protect us, our government continues to supply the terrorists with the very gas they need to make more missiles and launch them to try and kill our kids – it's a black comedy of the absurd!"

The Sderot residents allege that Hamas is siphoning off thousands of liters of Israeli supplied gasoline on the Gaza side of the Nachal Oz depot in order to create an artificial humanitarian crisis and bring world public opinion down on Israel. Israel, on its part, claims that it continues to supply the gasoline to Gaza so it can be used for humanitarian purposes such as hospitals, schools and a variety of critical and emergency services.

"Hamas can get petroleum from Egypt via Rafah or from other sources," said Attorney Nitsana Darshan-Leitner in sending the letters. "It makes no sense for Israel to continue to supply her enemies with fuel. In 2005 Israel "disengaged" from Gaza, with Israeli Jews paying a tremendous price in social and personal suffering as a result, so why are we continuing this charade? Either we are disengaged or not!"

If the residents demand to shut down the Nachal Oz depot and stop the supply of gasoline to Hamas is not adhered to, Shurat HaDin, on behalf of the Sderot families, will be filing a petition in Israel's high court of justice requesting that the court compel the government to cease and desist the supply of fuel to Hamas. "The
supply of fuel to Hamas in Gaza is as close to aiding and abetting the enemy as one can ever come. We supply them with gasoline, Iran supplies them with training, Syria supplies them with political cover – it's a perfect recipe for continued disaster. How can we complain about Iran and Syria with a straight face if we are aiding
Hamas in the same manner " concluded Darshan-Leitner.

Shurat HaDin – Israel Law Center (http://www.israellawcenter.org) is a Jewish human rights institute based in Israel and staffed by some of the country's leading activist attorneys. Shurat HaDin is dedicated to providing legal representation and resources for the numerous courtroom struggles, which are being waged in the Israeli, American and European courts on behalf of the Jewish State and serves as a central clearinghouse and litigation base for the multifarious legal battles that have been thrust upon Israel's citizens during recent years.

A Moral Outrage

Muslims in Gaza are not exactly chained to their homicide belts and kassam rockets. Israel doesn't stop them from succeeding; the Islamic tradition to hate others is entirely home grown. Via A Moral Outrage:
The world applauded when Israel withdrew from Gaza in 2005, forcibly removing Jewish settlers. At last, the Palestinians were free to show how they could build their own society.

But what did they do with their freedom? They elected the terrorist organization Hamas in 2006. First Fatah and now Hamas have rained 4,000 rockets on Israel, killed 24, and wounded 620 - the equivalent of killing 1,200 Americans and wounding 31,000. The citizens of Sderot and Ashkelon have suffered a collective trauma; children fear that when parents leave for work, they will never see them again.

And what does the world do? It criticizes Israel for a "disproportionate" response. Israel is discriminating in trying to defend its people. It attacks Gaza's rocket launchers, weapons factories, and terrorists, all hidden in civilian areas. What is a proportionate response? None at all, it seems.

Hamas kills indiscriminately. It makes no distinction between civilians and combatants. But it is Israel that earns the opprobrium. Would Paris, London, Bonn, or New York sit back quietly if terrorists attacked from sanctuaries somewhere just off their borders?

Palestinians continue to get away with their confidence trick of persuading the world that they are the victims. Hamas uses women and children as human shields and then exaggerates the casualties.

The U.S. forced the Israelis and the Palestinians to include Hamas in the 2006 election. Later, we caused the removal of Israeli control of the Philadelphi road, a crucial barrier in the protection against the smuggling of arms, insisting it be left to the Palestinians under Egyptian and European supervision. Israeli protests that foreign troops would not stop either terrorists or arms from making their way into Gaza went unheeded.

Hamas Declares Victory in Gaza Fighting

Having failed to defeat Israel, the uncivilized and backward Arabian culture claims they are victorious. If victory to them means their murderous leaders have been assassinated so that Israelis may live in peace, then I, like Mark Regev, wish them many more similar victories. From Hamas Declares Victory in Gaza Fighting:
Following five days of combat that left at least 117 Palestinians and three Israelis dead, Hamas declared victory and held a celebratory rally in Gaza City. "I wish them many more such victories," said Mark Regev, spokesman for Israeli Prime Minister Olmert. "I have no doubt that the incursion... succeeded in hurting the Hamas military machine. I also have no illusions that it's over." Israel has accused Hamas of intentionally choosing to store and launch its rockets in heavily populated areas, turning civilians into human shields.

Israel's War to Halt Palestinian Rocket Attacks

From Israel's War to Halt Palestinian Rocket Attacks:
The Kassam rocket threat started in 2001 and grew when the Palestinian Authority was under Fatah control. Even after the death of Arafat in November 2004, Kassam rocket fire from Gaza continued under the regime of Mahmoud Abbas. True, Abbas called on Palestinians to stop firing rockets into Israel in 2006, but on the ground, he and the Fatah leadership were either unwilling or unable to halt the Hamas attacks as they increased.

After Israel's disengagement from Gaza, the number of confirmed rocket strikes against Israel increased by more than 500 percent. The 2005 Gaza disengagement provided Hamas with a sense of empowerment and self-confidence that led to a clear-cut escalation in the employment of the rocket capabilities that they had previously acquired. The disengagement from Gaza led to the loss of Israeli control over the Philadelphi route between the Gaza Strip and Egyptian Sinai, allowing for a significant increase in the range and quantity of rockets in the Palestinian arsenal.

Israeli security forces recently discovered in the western Negev the remains of a new 175 mm. rocket of Iranian origin that has a range of 26 kilometers. Israeli security sources are also concerned that Iran will try to smuggle its Fajr rockets to Gaza in the future. A 45-kilometer-range Fajr 3, for example, could be smuggled in sections and assembled in Gaza. As long as the Philadelphi route is open for Hamas smuggling, the risk to Israel will grow as Iran exports rockets of increasing range to the Gaza Strip. The port of Ashdod is the next likely target, but should Fajr rockets reach Gaza, there is no reason why Hamas cannot pose a threat to Tel Aviv.

Presently, the Hamas leadership understands that repeated Katyusha attacks against Ashkelon will result in an Israeli ground incursion that can cost them nearly one hundred of their personnel. But without addressing the Philadelphi route or the northern Gaza launch sites, it is doubtful that these kinds of deterrence calculations alone will bring the Hamas rockets to a halt and alleviate the misery of the Israeli residents of Sderot.

White House Faults Hamas in Gaza Violence

Useless and impotent statements from The White House. From White House Faults Hamas in Gaza Violence:
The White House on Monday blamed the Palestinian militant group Hamas for causing the fighting between Israelis and Palestinians that has killed dozens and put a halt to peace talks. Gordon Johndroe, a spokesman for President Bush's National Security Council, said: "The No. 1 thing that has to happen is that Hamas has got to stop targeting Israeli citizens with rockets. It must stop."

33 Palestinians killed during ongoing IDF raids in Gaza Strip

Muslims chose war, now Muslims pay the consequences. Thirty-three Palestinians have been killed on Saturday and atleast 40 have been wounded in an IDF operation meant to combat the ongoing Palestinian rocket fire on Israeli cities in the western Negev. According to Palestinian sources, at least 16 of those killed were civilians, including a baby and two teenagers. Five IDF troops were wounded during the operations, two lightly to moderately, and three lightly. In all, 63 Palestinians have been killed since clashes between Israel and Hamas terrorists spiked Wednesday when an Israeli student at Sapir College in Sderot was killed by a Kassam rocket.

Hamas Confiscates Jordanian Aid Sent to Gaza

As we deconstruct poverty and occupation as the root causes of Muslim terrorism, it becomes clear once again that the disease is within Islam itself. From Hamas Confiscates Jordanian Aid Sent to Gaza:
At least 10 trucks with humanitarian aid sent to the Gaza Strip by the Jordanian Red Crescent Society were confiscated by Hamas police shortly after the trucks entered the territory on Thursday evening, according to aid officials in Jerusalem. Eight trucks had food products and another two had medicines. They were reportedly taken to Hamas-run ministries.

Initial reports said the intended target of the aid was the Palestine Red Crescent Society (PRCS) in Gaza. Hamas and the PRCS had a run-in in the past, when the Islamic group diverted another aid convoy. A spokesman for the Hamas police in Gaza said that the number of trucks was in fact 14 and they would be "delivered to Palestinians in need in the Gaza Strip."

He added that Hamas was the responsible body in the territory and it would decide how to distribute the aid.

Egypt: Gazans Used Counterfeit Money in Sinai

From Egypt: Gazans Used Counterfeit Money in Sinai:
About $1 million in counterfeit bills, apparently originating in Gaza, were seized in Sinai in the past few days, Egyptian security sources told the Palestinian news agency Ma'an on Thursday.

According to the sources, the Egyptians received warnings regarding counterfeit bills making their way into Sinai immediately after Hamas gunmen breached the Gaza-Egypt border, and these warnings were delivered to the merchants, most of whom made sure to examine the money.

Less than a week ago, the London-based Arabic-language newspaper al-Sharq al-Awsat reported that Hamas was seriously contemplating severing the Gaza Strip’s economic ties with Israel, quoting a senior advisor to Hamas leader Ismail Haniyeh.

The advisor, Ahmed Yousef, was asked whether Hamas was also considering abandoning the use of Israeli currency in the Strip. Yousef indicated that this “might be possible in the future. Residents of Gaza can always trade in American Dollars, Jordanian Dinars or Egyptian Pounds at a later point.”

Gaza Baptists Targeted by Extremists

From Gaza Baptists Targeted by Extremists:
Gaza is home to 1.5 million Muslims - and about 3,000 increasingly frightened Christians. The small evangelical Baptist community has been a principal target of the extremists because of its missionary work, which has been halted. "Christians get killed here, let alone a Muslim who converted," said Ashraf, 36, who did not give his last name. "I stopped going to church even before the [Hamas] coup." Recently, even his church leader, pastor Hanna Massad, fled to the West Bank.

Dimona Bombing Highlights Israeli Security Problem Along Egyptian Border

From Dimona Bombing Highlights Israeli Security Problem Along Egyptian Border:
Monday's suicide bombing in Dimona means the southern Negev has become the target for attacks and Israel is faced with a serious security problem along its 300-kilometer border with Egypt. In light of Egyptian difficulties in shutting off Gaza, a wave of additional terror attempts is expected in the coming weeks. In addition, the agreement with the Palestinian Authority whereby Israel allows previously wanted men to give up their weapons and remain free, which was considered a great success at the time, is starting to fall apart. There are now armed Fatah activists who are openly violating their agreements with the security forces.

Blame Hamas for Gaza Suffering

From Blame Hamas for Gaza Suffering:
While news about the suffering of Gazans fills the airwaves, there is a peculiar disinterest in the nightmare that is life for the people of Sderot and its vicinity in Israel. Every day, every few hours, the sirens wail their warning, giving terrified parents and children less than 15 seconds to take cover. The rockets are deliberately aimed at civilians. They fall on schools and streets and day care centers. A recent study shows 56% of Sderot residents have had their home hit by a rocket or shrapnel. More than 90% say their street or an adjacent one has been hit, and almost 50% know someone who was killed in such an attack. Every response by Israel draws international condemnation. Other countries have reacted to attacks against their population by pulverizing their opponents. Israel targeted militant leaders and tried economic sanctions.

International Law and Gaza: The Assault on Israel's Right to Self-Defense

From International Law and Gaza: The Assault on Israel's Right to Self-Defense:

International law authorizes Israel to initiate military countermeasures in Gaza. If Gaza is properly seen as having independent sovereignty, Israel's use of force is permissible on the grounds of self-defense. If Gaza is properly seen as lacking any independent sovereignty, Israel's use of military force is permissible as in other non-international conflicts.

The rule of "distinction" includes elements of intent and expected result: so long as one aims at legitimate targets, the rule of distinction permits the attack, even if there will be collateral damage to civilians. The rule of "proportionality" also relies upon intent. If Israel plans a strike without expecting excessive collateral damage, the rule of proportionality permits it. Israeli attacks to date have abided by the rules of distinction and proportionality.

Israel's imposition of economic sanctions on the Gaza Strip is a perfectly legal means of responding to Palestinian attacks. Since Israel is under no legal obligation to engage in trade of fuel or anything else with Gaza, or to maintain open borders, it may withhold commercial items and seal its borders at its discretion.

The bar on collective punishment forbids the imposition of criminal-type penalties to individuals or groups on the basis of another's guilt. None of Israel's actions involve the imposition of criminal-type penalties.

There is no legal basis for maintaining that Gaza is occupied territory. The Fourth Geneva Convention refers to territory as occupied where the territory is of a state party to the convention and the occupier "exercises the functions of government" in the territory. Gaza is not territory of another state party to the convention and Israel does not exercise the functions of government in the territory.

The fighting in Gaza has been characterized by the extensive commission of war crimes, acts of terrorism and acts of genocide by Palestinians, while Israeli countermeasures have conformed with the requirements of international law.

International law requires states to take measures to bring Palestinian war criminals and terrorists to justice, to prevent and punish Palestinian genocidal efforts, and to block the funding of Palestinian terrorist groups and those complicit with them.

The Enemy Within

From The Enemy Within:

As always, Gazans look around, see how terrible conditions are, and point fingers. Many blame Israel. Or they blame the U.S. Or they blame Fatah, rival to Hamas. If things are to improve in Gaza, then that reflexive attitude is one of the first things that must change. Until most Gazans fix the blame for their miserable living conditions where it belongs - on their elected leaders of Hamas - Gaza will remain poised on the brink of crisis, sending rockets into Israel and then complaining bitterly when its foe retaliates.

This really isn't all that complicated. It's quiet for quiet. If the Palestinians stop lobbing rockets into Israel, there will be no retaliation. This is not a matter of the "cycle of violence." Israel withdrew from Gaza in 2005. That was supposed to end the "provocation" of the settlements and stop the rocket fire. But it hasn't. There's also no doubt Hamas could stop the rockets. Unfortunately, the leaders of Hamas find it to their political and economic advantage to allow their people to suffer while they smuggle arms and money from Iran and elsewhere to continue the campaign of terror against Israel.

As long as Hamas is in power, Gaza will be driven further into misery, further from the path that would lead to an independent state. For Gazans, the real enemy is within.
